Not all extrajudicial killings are unlawful. especially if they are for Israel , thinks Alan Dershowitz.
Alan Dershowitz: It is against the law of Dubai for an Israeli agent to kill a combatant against Israel while he is in Dubai. So the people who engaged in the killing presumptively violated the domestic law of Dubai, unless there is a defense to such a killing based on international principles regarding enemy combatants.
WTF? your defense is Israel should not abide by any other states laws when looking for a target. murder in another country is still murder. would you like it if Mexico started killing folks in the U.S in the name of its drug war?
Alan Dershowitz:This was not an ordinary murder. It was carried out as a matter of state policy as part of an ongoing war.
correct , Israel wants to stop Hamas from protecting its territorial integrity. why should Palestinians have a homeland ahh?
Alan Dershowitz: Richard Goldstone, in his interviews, has suggested that Israel should protect itself from these unlawful attacks by more proportionate retail measures, such as commando raids and targeted killing of terrorists engaged in the firing of rockets. Well, there could be no better example of a proportionate.
HAMAS: “We have maintained that the confrontation between us and the Israeli enemy be in the occupied land,” said Zahar. “Israel wants to change the rules of the game and to open the international field for battles so it will be responsible for this,” Mahmoud al-Zahar - told reporters
I guess Israel wont mind if Hamas opens a new front in this War. me thinks He’s willing to swallow any atrocity, as long as it’s committed by the Israeli country.
- other times this guy opened his trap for Israel , Alan Dershowitz argues that all those civilians being killed in Lebanon may not really be civilians after all: anyone who declines to leave their home despite Israeli orders to do so is, ipso facto, complicit with terrorism and presumably fair game once the Israeli invasion gets under way. How they get totted up after the killing is over depends on where they fall on Dershowitz’s nebulous “continuum.” - more @ washingtonmonthly.com

Mr Dershowitz,
There are several points in your blog that are incorrect:
1. “…engages in an extrajudicial killing, as does every policeman who shoots a fleeing felon.” Not true, it is not legal for the police to shoot a felon simply because they are fleeing.
2. Israel and Palestine (Hamas) are in a state of cease-fire, not “at war” as you proclaim. If Israel accepts responsibility and says it was a military strike, they will have broken their cease fire; something I am sure they would not be willing to accept in the current atmosphere of peace-talks talk.
Further, I am in total disagreement with your conclusion. Carrying out operations in another state without the knowledge of that state’s government is absolutely wrong. For example, how would you feel about the Mexican authorities coming into the US and carrying out their drug wars here without the knowledge of our authorities? Or if Iran were to chase their revolutionaries into Iraq and drop bombs there? What you are suggesting is that we ignore the sovereignty of nations - a very bad precedent that was set post 911, and must not be allowed to continue.
trying to use international law to justify israeli action is just about the most hypocritical argument anyone could make. let’s ignore the fact for a moment that hamas is based in territories illegally occupied and settled by israel after an illegal war of aggression launched by israel against its neighbors in ‘67, therefore making resistance legal under international law, but if israel were to allow the 4,000,000 palestinian refugees in neighboring countries that it ethnically cleansed in ‘48 to return to their homes in Israel and Palestine, as required by international law, and established a truly democratic state with equal rights regardless of ethnicity, there would be no need for violent resistance. are we really going to take advice on right and wrong from a man who was a lawyer for OJ Simpson and has always been a shill for the pro-israel lobby.
